General Terms and Conditions of Sale

These terms and conditions govern the BIM consultancy, vocational training and software licence resale services provided by CADatWORK. The final, signed version is supplied with each quotation.

Purpose

These General Terms and Conditions of Sale define the rights and obligations of the parties in connection with the sale of CADatWORK's services. Any order constitutes unreserved acceptance of these General Terms and Conditions of Sale.

Prices & payment

Prices are stated in euros, excluding taxes. The applicable VAT rate is the rate in force on the invoice date. Unless otherwise agreed, invoices are payable within 30 days net. Any late payment shall incur a penalty at the statutory rate and a fixed compensation charge of €40 for recovery costs (Article L.441-10 of the French Commercial Code).

Vocational training

Training services are delivered in accordance with Articles L.6353-1 et seq. of the French Labour Code. A training agreement is signed before any session. The procedures for enrolment, postponement, cancellation and assessment are detailed in the internal regulations provided to the trainee.

Right of withdrawal

As the services are intended for business clients, the right of withdrawal under Article L.221-18 of the French Consumer Code does not apply, unless exceptions are expressly agreed.

Liability

CADatWORK is subject to an obligation of reasonable care, not an obligation to achieve a specific result. It shall not be liable in the event of force majeure or improper use of the deliverables by the client. In all cases, any compensation shall be capped at the amount, excluding taxes, actually paid for the service concerned.

Mediation

Governing law

These General Terms and Conditions of Sale are governed by French law. Failing an amicable settlement, any dispute shall fall within the exclusive jurisdiction of the courts for the district in which CADatWORK's registered office is located.
